Meet Carter Martell
Carter Martell obtained his law degree from the University of Toronto Faculty of Law and articled at the Crown Law Office – Criminal, where he worked primarily on criminal appeals. He has practiced at Martell Defence since 2015. He appears regularly in the Superior Court of Justice and the Ontario Court of Appeal and has acted as intervening counsel at the Supreme Court of Canada on behalf of the Criminal Lawyers’ Association, The Advocates’ Society, and the Empowerment Council.

Appeals
Our system of criminal justice doesn’t always get it right the first time.
We can help you appeal your conviction or sentence, and apply for bail pending your appeal. We are often able to arrange for clients to be released on bail the day of sentencing by making an application for bail in advance, so it is important to contact us as soon as possible after conviction.
We will order the transcript from your trial and conduct a thorough investigation into all potential grounds of appeal before advising you on the strongest grounds to pursue.
We handle appeals in all criminal cases, as well as appeals against findings of Not Criminally Responsible, and appeals against dispositions of the Ontario Review Board. We also represent people who are facing an appeal by the Crown against their acquittal or their sentence.

We can assist clients and lawyers by conducting applications or producing application material for Charter motions, motions to admit or exclude evidence, and constitutional challenges.
